Pavement Cut Policy

Pavement Cut Policy - Introduction

The Alpental Community Club (ACC) has adopted the following policy regarding cuts in pavement for any purpose under ACC roads and Right of Way’s. This policy applies to all entities, whether private/residential, governmental (city, state, county) or commercial (utility providers), and is effective August 11th, 2008.

This policy is being implemented in order to protect one of our most valuable assets, our roads, and to avoid the costly effects of poor craftsmanship and construction process.  Proper practice is mandatory due to our harsh weather environment and our objective of preserving the longevity of our roads. 

Implementation of this policy is also the result of numerous studies conducted by multiple groups and organizations that have determined that poorly restored pavement cuts cause permanent structural and functional damage to roadways.  Other studies show that in making pavement cuts, the pavement beyond the trench may be weakened by sagging which results from loss of lateral support. Heavy construction and snow removal equipment traffic also weakens the area adjacent to the trench. Studies have shown that the pavement life will likely be reduced by pavement cuts. Poorly constructed patches do not last through the life of the existing road and fail prematurely when there is a lack of good construction techniques used when backfilling and compacting. A poorly constructed pavement cut usually requires repair before the road needs to be resurfaced; problems typically appear in the first few years. Studies also reveal that patch areas probably require thicker overlays compared to the rest of the pavement in the area.

Historically poor practice on restored pavement cuts in the Alpental Community have increased  ACC Member maintenance costs, snow removal costs, future rehabilitation costs, as well a rough ride for the homeowners of ACC.

There is a common good for all utilities to be placed in the Public Right of Way. All parties shall strive to reduce the burden to the homeowners, and damage to the roadways.  Your compliance is greatly appreciated.

All road cut construction shall follow the construction and warranty requirements detailed below.

Pavement Cut Policy

Cutting Moratorium

A pavement cut moratorium will be in effect for a period of three (3) years from the most recent asphalt overlay, i.e. August 11, 2008 until December 31, 2011. Following such time the ACC pavement cut policy will stay in place until an addendum is released by the ACC defining any changes to the previous policy document.

Exceptions

Emergency Repair

Any road will remain available to be cut if there is no other means to take care of an emergency situation (broken water, sewer or electric lines).  However, even in the event of an emergency situation it is still the responsibility of the entity(s) or responsible party requiring the road cut to inform the ACC of such intent, proving to the ACC Board or Board designated representative the true urgency of the need and that all other options have been exhausted. 

If emergency repairs are needed due to safety concerns, the responsible party shall have up to seven (7) days to make such temporary repairs. If these repairs are not accomplished within the specified timeframe, the work may be privately contracted by ACC and the utility or responsible party shall be assessed the associated fees for the repairs, including all ACC documented labor required for the effort to be billed at $150/hour.

All utility cut construction shall follow the construction and warranty requirements.

 

Post-Moratorium

ACC Board or Board appointed representative shall be notified until the year 2023 of all road cut needs or activity.  All Pre and Post Construction Guidelines must be adhered to until this time.

Construction Requirements & Rules

  1. No road cutting for (3) years.
  2. After (3) year moratorium period expires the construction requirements outlined below will apply until the year 2023.
  3. No patching material will be allowed within an existing patch if the new patch exceeds seventy (70) percent or more of the existing patch. In this case, the entire existing patch must be replaced.
  4. When two (2) or more patches are created within a given job that measure 15 feet or less longitudinally or transversely they will be incorporated into a single patch.
  5. Anytime five (5) or more patches are required within a 350 foot longitudinal area, the responsible party for the cut  will notify the ACC to determine if individual patching  will be allowed or the entire area (from end cut to end cut) shall be treated as one (1) patch or repair.
  6. All road cuts shall be pre-approved before beginning work.
  7. All shoulders shall be restored to their original condition.  All paving debris on the road edges must be picked up, providing a neat and restored look upon completion.
  8. The ACC reserves the right to require return trips by the responsible party to “fix” patches that do not meet the ACC acceptance criteria.  Such trips will be at no cost to the ACC and proper acceptance must be received before any warranty periods begin.
  9. The completed surface of all courses shall be of uniform texture; smooth, uniform as to crown and grade and free from defects.
  10. The completed surface of the wearing course shall not vary more than 1/4 inch from the lower edge of a ten foot straightedge placed parallel to the centerline.
  11. Recognition and consideration will be made for existing roadway conditions.

Warranty Requirements

All cut and patch work performed on ACC property will require a five (5) year warranty from the date of repair completion and acceptance by the ACC Board or board approved representative.  Acceptance is not granted until the ACC has received its close-out documentation package.  Once the close out documentation is received the warranty period starts from that date forward.

If an emergency occurs which precludes prior written approval the utility must contact the ACC for approval within 2 business days of said emergency for approval. Before a pavement cut can receive a final asphalt patch, an ACC representative shall inspect the cut and compacting for compliance with the policy standards and requirements.

Prior Approval

All work in the ‘ACC Road Right-of Way’ requires written prior approval. The Utility shall request prior approval before performing all work.

Pre-Construction Submittals

The responsible party shall provide the ACC or appointed ACC representative pre-construction drawings of the intended area to be cut.  Written approval must be provided by the ACC prior to commencing work.  This policy is to ensure that the cutting entity understand the requirements of this document and agrees to adhere to them.

Post-Construction Submittals/Close-Out/Acceptance

As-Builts – responsible party shall submit to the ACC a signed drawing of the cut location which shows the cut, road name, utility buried, depth and all other relevant dimensional data.

Pictures – Included in the close-out package shall be photos documenting the before, during and after of the cut or cuts performed.

Dates of work performed and warranty period dates – Provide a written letter on company letterhead signed by an executive of the company or the resident that states the dates of work performed, the reason and the acknowledgement and offering of the warranty expressed in this document.

Contact information – contact information for the company and the individual within the company handling claims shall be provided to the ACC as a part of the close documentation.

Company and Individual Signature – signature(s) shall be provided on all submitted documents.

ACC Documentation

The ACC will make available a Master Drawing Set with the most updated utility locate information available.  This drawing set will be updated upon completion of any road work performed.  As built drawings provided by the responsible party will be delivered as expressed and information incorporated into the Master Set by the ACC.

All cutting or cutting requests shall be funneled through one or both of these contacts prior to commencing work.

Temporary Patching

As the ACC roads are subject to harsh winter conditions all efforts should be made to avoid pavement cuts during the winter season.  If an emergency winter pavement cut is required the utility shall install and maintain a temporary patch until it can construct a permanent patch during warmer months. The Utility shall maintain the temporary patch until the patch has been permanently restored. Damaged caused by a poorly maintained patch shall be the sole responsibility of the Utility and or contractor.

Responsible Party

The Utility or Ultimately responsible party shall be responsible for all construction and warranty requirements of this policy. Utilities will provide identity of excavator/contractor as known to the ACC. ACC will attempt to get contractor to correct warranty defects. If work is to be provided by a subcontractor for utilities, the utility will assume responsibility if the contractor can not/will not make repairs.

Heavy Equipment

Heavy equipment will not be allowed on Alpental roads without prior written approval from the ACC Board or appointed representative.  The intent of this clause is to prevent damage from machinery with steel tracks or tracks that can damage the road surface. There are ways to prevent road damage even when these types of machines are required.

All necessary steel tracked vehicles will be required to download and upload in a manner that does not have them operate on the road surface.  Vehicles will be driven only on client or ACC right of way to prevent damage.  Any damage caused by such vehicle due to recklessness or non-compliance to this rule will be the responsibility of the entity or responsible party.  If repairs are needed due to such negligence the responsible party shall have up to seven (7) days to make such repairs. If these repairs are not accomplished within the specified timeframe, the work may be privately contracted by ACC and the utility or responsible party shall be assessed the associated fees for the repairs, including all ACC documented labor required for the effort to be billed at $150/hour.

Exception

Some level of leniency will be given to the contracted Snow Removal Contractor.  However, significant damage caused by poor practice or negligence will be the responsibility of the contractor and repaired immediately the following spring.
